DiabetesIQ Terms of Service

These terms are a contract between you and StayHealthy, Inc. governing your use of DiabetesIQ (the app, website, and related services). By creating an account you agree to them. We've kept them as readable as we can.
1. What DiabetesIQ is — and is not (read this one)
DiabetesIQ is a wellness and lifestyle app: it helps you log glucose readings, understand your meals, and build healthy habits.
DiabetesIQ is not:
- a medical device — it is not FDA-cleared or approved, and it does not diagnose, treat, cure, mitigate, or prevent any disease;
- a source of medical advice — Emma is an AI coach for lifestyle and education. Nothing in the app — no score, chart, estimate, insight, or chat message — is medical advice;
- a dosing tool — never use DiabetesIQ to calculate, adjust, or time insulin or any medication. The app will refuse to give dosing advice by design; do not try to work around that, and do not treat anything it says as dosing guidance;
- a replacement for your glucose meter, CGM, or care team — estimated A1C (GMI), time-in-range, meal scores, and trend indicators are informational estimates computed from the data you log. Always confirm health decisions with your own measurements and your healthcare providers;
- an emergency service — if the app shows a safety message about a very low or very high reading, follow it, but in any emergency call 911 or your local emergency number.
Talk to your doctor before changing your diet, exercise, or diabetes management routine.
2. Eligibility
You must be 18 or older. You may only create an account for yourself, and the information you provide must be accurate.
3. Your account
Keep your credentials secret; you're responsible for activity on your account. Tell us immediately through stayhealthy.com if you suspect unauthorized access. Your data belongs to you — our Privacy Policy explains how we handle it, and it never permits selling your health data.
4. Price
DiabetesIQ is free during early access: every feature, no charge, no payment method, no trial clock. We collect no billing information. If we ever introduce paid plans in the future, we will update these terms first, show any price clearly before you are asked to pay, and never charge you without your explicit, affirmative sign-up. Whatever we do with pricing later, viewing and exporting the data you have already logged stays free, always.
5. Acceptable use
Don't:
- use the app for anyone other than yourself, or enter another person's health data;
- attempt to bypass security, per-user data isolation, or rate limits;
- try to make Emma produce medical, dosing, or diagnostic advice, or use prompts designed to defeat the app's safety rules;
- upload unlawful content or content that isn't yours (meal photos should be of food, not people who haven't consented);
- scrape, resell, reverse-engineer, or use the service to build a competing dataset;
- use the app where failure of the app could cause harm (it is not built for clinical use).
We may suspend or terminate accounts that violate these rules; where reasonable we'll warn you first. You can stop using DiabetesIQ anytime and delete your account in Settings.
6. AI features
Emma and the meal-photo analysis are powered by artificial intelligence and are clearly labeled as AI. AI output can be wrong. Confidence scores indicate how well an insight is supported by your data — they are honesty signals, not guarantees. AI features require your opt-in consent (see Privacy Policy) and can be switched off in Settings without losing the rest of the app.
7. Intellectual property
We own the app, its software, design, and branding (DiabetesIQ and stayhealthy®). You own your data. You grant us only the limited license needed to store and process your data to run the service for you, as described in the Privacy Policy — nothing more.
8. Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of health-related estimates. We do not warrant that the app will be uninterrupted, error-free, or that AI outputs or nutrition estimates are accurate or complete. Some states don't allow certain warranty disclaimers, so parts of this section may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law: StayHealthy, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for health outcomes resulting from reliance on the app contrary to Section 1; and our total liability for all claims in any 12-month period is capped at the greater of one hundred US dollars or the amount you paid us in that period. Nothing in these terms limits liability that cannot be limited by law (including, where applicable, gross negligence or willful misconduct).
10. Dispute resolution
We want to fix problems, not litigate them. Informal resolution first: before filing any claim, contact us through stayhealthy.com; we get 30 days to make it right. Any dispute that can't be resolved informally will be brought in the courts of the state in which StayHealthy, Inc. is organized, under that state's law, excluding its conflict-of-law rules.
11. Changes to these terms
If we change these terms materially, we'll notify you in the app and by email at least 30 days before the change takes effect, and continuing to use the app after that constitutes acceptance. We will never use a terms update to grant ourselves rights to sell your health data — that door stays closed permanently.
12. Miscellany
If part of these terms is unenforceable, the rest stands. These terms plus the Privacy Policy are the whole agreement. We may assign these terms in connection with a merger or sale (your privacy protections travel with your data); you may not assign them. Failure to enforce a term isn't a waiver.
